(LEAD) Lotte files constitutional petition over skyscraper
By Nam Kwang-sik SEOUL, Jan. 1 (Yonhap) -- South Korean retail giant Lotte Group said Tuesday that it has lodged a constitutional petition against the government's disapproval of the construction of a proposed 112-story building in Seoul.
Lotte Group is pushing to build a 555-meter-high skyscraper next to Lotte World amusement park in Jamsil, southeastern Seoul, but the central government has disapproved of the group's plan, citing safety and security reasons.
The group's affiliate, Lotte Moolsan Co., filed a petition with the Constitutional Court in mid-November last year, claiming that the central government's rejection is unconstitutional, the group said.
The Defense Ministry had filed a petition in May calling for Lotte Group's plan to be scrapped, saying the building would be located in the flight safety control zone of a nearby military airport.
The site for the envisioned skyscraper is located just 5.7 kilometers away from Seongnam Airport, a strategic Air Force base used by presidents and dignified foreign guests.
Because of its proximity to the airport, the government proposed that the height of the planned building be reduced to meet the maximum height allowed of about 200 meters.
In April, the Seoul City government had approved the construction of the building. However, Seoul City withdrew its approval in July in accordance with the Defense Ministry's petition.
